Court Ruling Rap of DeAngelo Bailey’s Lawsuit Against Eminem

On August 21, 2002 DeAngelo Bailey filed a complaint against Eminem for defamation. The reason for this were (1) Eminem’s lyrics on his 1999 song “Brain Damage”, which contained the following lines:

Way before my baby daughter Hailie
I was harassed daily by this fat kid named DeAngelo Bailey
An eighth grader who acted obnoxious, ‘cause his father boxes
So every day he’d shove me in the lockers
One day he came in the bathroom while I was pissin'
And had me in the position to beat me into submission
He banged my head against the urinal ‘til he broke my nose
Soaked my clothes in blood, grabbed me and choked my throat

and (2) Eminem’s statements on his April 1999 interview with Rolling Stone:

Motherfucker used to beat the shit out of me. I was in fourth grade and he was in sixth. Everything in the song is true: one day he came in the bathroom, I was pissing, and he beat the shit out of me. Pissed all over myself. But that’s not how I got really fucked up. [One day he] came running from across the yard and hit me so hard into this snowbank that I blacked out.

On October 17, 2003, Judge Deborah Servitto dismissed the defamation suit and curiously wrote this ten-stanza footnoted explanation of her ruling at the end of her paper.
